2. Service Description

AI Birthday Song Generator provides an AI-powered song generation service. We generate customized birthday songs based on the prompts and information you provide.

3. Payments and Delivery

Our service operates on a pay-per-song basis. You can generate and preview a song for free. To download the high-quality, watermark-free MP3 version, a one-time payment is required. Once payment is successful, you will be granted access to download the file.

4. Billing and Refunds

All purchases are final and non-refundable. Because each song is generated on demand using third-party AI infrastructure and immediately delivered as a digital download upon successful payment, we are unable to offer refunds once the file has been made available to you.

If you believe you were charged in error (e.g., duplicate charge or payment processed without delivery), please contact us at [email protected] within 7 days of the transaction and we will investigate promptly. Approved error-based refunds are typically processed within 5–10 business days.

5. Intellectual Property

Upon purchase, you own the rights to the generated song and are granted a license to use it for both personal and commercial purposes. The underlying AI models and platform remain the property of AI Birthday Song Generator and its licensors.

6. Acceptable Use Policy

You agree to use AI Birthday Song Generator only for lawful purposes and in accordance with these Terms. We reserve the right to refuse service, remove content, or terminate access for anyone who violates these policies.

Content Standards — Prohibited Categories

You must not use our service to generate content that:

• Sexually explicit / NSFW — includes pornography, explicit sexual acts, or sexually suggestive material.
• Violent or graphic — glorifies, promotes, or depicts extreme violence, gore, or bodily harm.
• Hate speech — attacks, demeans, or incites violence or discrimination against individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Child safety (CSAM) — any content that sexually exploits, endangers, or is otherwise harmful to minors.
• Deepfakes / impersonation — realistic imitation of a real, identifiable person's voice, likeness, or identity without their explicit consent.
• Copyright / trademark infringement — lyrics, melodies, brand names, or other material that infringes the intellectual property rights of any third party.

Reporting Violations

If you encounter content generated through our platform that you believe violates these standards, please report it by emailing [email protected] with the subject line "Content Report" and a brief description. We aim to acknowledge all reports within 2 business days.

Content Moderation

We apply automated filters at the prompt-input stage to detect and block requests that fall into the prohibited categories above. Human review is performed on flagged or reported content. We reserve the right to permanently remove any generated content and suspend or terminate the account of any user found to be in violation of this policy.

7. AI Disclaimer

AI Birthday Song Generator is an independent wrapper and interface built on top of third-party AI music and voice generation models. The underlying models currently in use include Suno and Udio for AI music and song generation. Our platform is an independent product and is not affiliated with, endorsed by, or sponsored by Suno AI, Udio, or any other model provider. We advertise only the features we deliver through our custom interface.

8. Disclaimers & Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

8.2 AI-Generated Content Disclaimer

AI-generated songs and lyrics may contain errors, inaccuracies, or unintended content. You are solely responsible for reviewing all outputs before use. We do not guarantee that any generated song will be suitable for any particular purpose.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI BIRTHDAY SONG GENERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
